Terms of Service

1.Agreement to Terms
By accessing or using anixiv.com or any Anixiv service, you agree to be bound by these Terms of Service. If you do not agree, do not use the platform.
- You must be at least 18 years old to use Anixiv.
- You represent that you have the legal capacity to enter into a binding agreement.
- If you are using the platform on behalf of a business, you represent that you are authorized to bind that business to these Terms.
2.Definitions
The following terms have specific meanings throughout this document:
- Platform: the Anixiv website, mobile application, and all related services operated by COM Consulting Group, LLC d/b/a Anixiv.
- Client: a user who requests and receives beauty services through the Platform.
- Provider: an independent contractor who offers beauty services through the Platform.
- Service Request: a client's posted request describing a desired beauty service, including date, location, and budget.
- Bid: a provider's offer to perform a service at a stated price and estimated duration.
- Booking: a confirmed appointment between a client and provider following bid acceptance and payment authorization.
- Scope Change: a provider-initiated adjustment to the agreed service scope or price, submitted through the Platform during an active booking.
- Platform Fee: the 10% fee Anixiv charges on marketplace bookings, deducted from the provider's payout.
- Anixiv / We / Us: COM Consulting Group, LLC d/b/a Anixiv, the legal entity operating the Platform.
3.The Anixiv Platform
Anixiv is a marketplace that connects clients with independent beauty service providers. Understanding the nature of this relationship is important:
- Anixiv is NOT the provider of beauty services. Providers are independent contractors, not employees, agents, or representatives of Anixiv.
- Anixiv does not guarantee the quality, safety, legality, or suitability of any services offered through the Platform.
- Anixiv does not guarantee that a provider will be available for any request, or that a request will receive any bids.
- Anixiv facilitates the connection, payment processing, and communication between clients and providers. The service relationship is between the client and provider directly.
4.Account Registration and Security
- You must provide accurate, current, and complete information during registration.
- You are responsible for maintaining the confidentiality of your account credentials. Do not share your password with anyone.
- You must immediately notify Anixiv at support@anixiv.com of any unauthorized account access or security breach.
- Anixiv reserves the right to suspend or terminate accounts for violations of these Terms, suspected fraud, or abusive behavior.
- One account per person. Do not share accounts or create multiple accounts without express written permission from Anixiv.
- You are responsible for all activity that occurs under your account.
5.Provider Terms
Providers who offer services through the Platform agree to the following. Providers must also review and accept the separate Provider Agreement.
Independent Contractor Status
Providers on Anixiv are independent contractors, not employees, agents, or representatives of COM Consulting Group, LLC d/b/a Anixiv. Nothing in these Terms creates an employment relationship, partnership, joint venture, or agency relationship between Anixiv and any Provider.
As an independent contractor, each Provider:
- Sets their own prices for services. Anixiv does not set, suggest, or control Provider pricing.
- Controls their own schedule and availability. Anixiv does not assign shifts, require minimum hours, or mandate specific working times.
- Chooses which service requests to bid on or decline. Anixiv does not assign work to Providers.
- Provides their own tools, equipment, products, and supplies. Anixiv does not provide materials for the performance of services.
- May work on other platforms, accept clients outside of Anixiv, and maintain their own independent business simultaneously.
- May hire subcontractors or assistants at their own discretion.
- Is solely responsible for the quality, safety, and legality of their services.
- Is solely responsible for their own taxes, including federal and state income tax, self-employment tax, and any applicable Arizona Transaction Privilege Tax.
- Is solely responsible for maintaining all required professional licenses, certifications, permits, and insurance coverage required by applicable federal, state, and local laws.
Anixiv may provide Providers with training on how to use the Anixiv platform. This training relates solely to platform functionality and does not constitute training on how to perform beauty services, nor does it establish an employment relationship.
Anixiv may issue IRS Form 1099-K or 1099-NEC to Providers as required by applicable tax law for payments processed through the platform.
Licensing and Insurance
Providers are solely responsible for maintaining all professional licenses, certifications, and permits required to legally perform their services in their jurisdiction, including all applicable Arizona Barbering and Cosmetology Board requirements. Anixiv verifies provider credentials as part of its onboarding process, but this verification does not guarantee the validity, currency, or scope of any license or certification. Providers must promptly update their credentials on the platform if their licensing status changes.
Providers are strongly encouraged to carry professional liability insurance and general liability insurance appropriate for the services they offer. Anixiv does not provide insurance coverage for Providers or their services. By using the platform, Providers acknowledge that they are solely responsible for any claims, injuries, damages, or losses arising from their services.
Additional Provider Obligations
- Accurate representation. Providers must accurately represent their skills, experience, portfolio, and availability on the Platform. Misrepresentation is grounds for account termination.
- Background verification. Providers must pass Anixiv's background check and document verification process before going live on the Platform.
- Off-platform solicitation. Providers must not solicit clients introduced through the Platform for off-platform bookings to circumvent Platform Fees. Violation of this provision results in immediate account suspension and may result in a circumvention fee equal to 20% of the estimated value of any off-platform arrangement.
- Content license. Providers grant Anixiv a non-exclusive, royalty-free, worldwide license to display their portfolio photos, bio, and reviews on the Platform and in Anixiv marketing materials. Providers retain ownership of their content.
6.Client Terms
- Accurate requests. Clients are responsible for providing accurate and complete service descriptions, location information, and inspo photos.
- Availability. Clients must be present (or arrange authorized access) at the confirmed service location at the scheduled appointment time.
- Health disclosure. Clients understand that beauty services carry inherent risks, including allergic reactions, skin sensitivity, chemical burns, hair damage, and infection. Clients assume responsibility for disclosing all relevant health conditions, allergies, medications, and sensitivities to their provider before the service begins.
- Respectful conduct. Clients agree to treat providers with respect and professionalism. Harassment, discrimination, sexual misconduct, or abusive behavior toward any provider will result in immediate account termination.
- Age requirement. Clients must be at least 18. Services for minors require a parent or legal guardian to submit the request and be present for the entire appointment.
- Off-platform payments. Clients agree not to arrange payment directly to providers for Platform-originated bookings. All payments must be processed through the Platform. Clients who engage in off-platform payments forfeit Anixiv's dispute resolution protections, chargeback coverage, and payment guarantees.
7.Bidding and Booking Process
- Request modes. Clients may post requests in two modes: "ASAP" (first available provider accepts) or "Open to Bids" (multiple providers bid and the client chooses).
- Bid windows. Open to Bids requests have a time-limited window during which providers may submit bids. The window is calculated based on how far in advance the appointment is scheduled.
- Binding bids. Bids are binding offers. If a client accepts a provider's bid, the provider commits to performing the service at the quoted price and estimated duration.
- Bid caps. Anixiv reserves the right to limit the number of bids per request.
- Auto-bidding. Providers may enable auto-bid functionality, which uses predefined pricing rules to automatically submit bids on matching requests. Providers are fully responsible for all bids submitted via auto-bid.
- Booking confirmation. A booking is confirmed when a client accepts a bid and a payment hold is successfully placed on their payment method.
8.Pricing, Payments, and Fees
- Payment processor. All payments are processed through Stripe Connect. Anixiv does not directly handle or store credit card numbers or sensitive payment data.
- Payment hold. A hold is placed on the client's payment method when a booking is confirmed. The hold is captured (charged) upon service completion.
- Marketplace Platform Fee. Anixiv charges a 10% Platform Fee on marketplace bookings. This fee is deducted from the provider's payout before disbursement.
- Client Booking Fee. Clients are charged a booking fee of 5% of the service price (minimum $3.00, maximum $15.00) on each marketplace booking. This fee is charged to the client in addition to the service price and does not affect the provider's payout. The booking fee is waived on each client's very first completed marketplace booking. The booking fee is non-refundable except as part of a full refund for a cancelled or disputed booking.
- Direct bookings. Bookings made through the "My Clients" feature carry a 0% Platform Fee and no client booking fee. Standard Stripe processing fees (~2.9% + $0.30) still apply.
- Deposits. Some services may require a deposit at the time of booking. Deposit amounts are set by the Provider and capped at 50% of the service price. The deposit is applied toward the total service price. Deposits are charged immediately upon booking confirmation. If the Client cancels more than 24 hours before the appointment, the deposit will be refunded. Cancellations within 24 hours of the appointment forfeit the deposit. If the Provider cancels, the full deposit is refunded to the Client immediately.
- Auto-payouts. Provider payouts are processed automatically upon booking completion via Stripe Connect. Payouts may be held for admin review in certain circumstances.
- Tipping. Tips are optional and processed separately after service completion. 100% of tips are disbursed directly to the provider. Anixiv does not take any portion of tips. Tips appear as a separate line item on the client's payment statement.
- Currency. All prices are in US Dollars (USD) unless otherwise stated.
- Tax records. Anixiv retains anonymized booking and payment records for 7 years to comply with IRS record-keeping requirements.
9.Scope Changes
If the actual scope of work differs from the original request during an active appointment, the following process applies:
- The provider may submit a Scope Change request through the Platform app, specifying the type (Required or Recommended) and the revised price.
- Required Scope Change: the original service cannot be performed as described without the change. Client has 5 minutes to approve or decline.
- Recommended Scope Change: an optional upgrade. Client has 5 minutes to approve or decline. Declining a Recommended change does not affect the original booking.
- If a client approves a Required Scope Change, the payment hold is updated to the new amount.
- If a client declines a Required Scope Change, the booking is cancelled. The provider receives 50% of the original bid price as a show-up fee. The client is refunded the remaining 50%.
- If a client does not respond within 5 minutes: a Required Scope Change is treated as declined; a Recommended Scope Change defaults to the original scope and price.
10.Cancellation Policy
- More than 24 hours before appointment: full refund to the client, no penalty to either party.
- Within 24 hours but more than 4 hours before appointment: 50% of the service price is charged to the cancelling party.
- Within 4 hours of appointment or no-show: 100% of the service price is charged. No refund is issued.
- Provider no-show: the client receives a full refund plus a $15 platform credit. The provider's account may be suspended pending review.
- Repeated cancellations: providers who repeatedly cancel accepted bookings may receive strikes. Three strikes within 90 days results in account suspension.
- Anixiv reserves the right to waive cancellation fees in documented cases of emergency, serious illness, severe weather, or other extraordinary circumstances at its sole discretion.
11.Reviews and Ratings
- Clients may leave a review following a completed booking. Reviews include a star rating (1 to 5) and optional written feedback.
- Reviews must be honest and based on the actual service experience.
- Anixiv will remove reviews that contain hate speech, threats, discriminatory language, personally identifiable information, or other content that violates these Terms.
- Providers may respond publicly to reviews through the Platform.
- Anixiv does not edit review content except to remove violations.
- Fake reviews (from fake accounts, incentivized reviews, self-reviews, or competitor reviews) are strictly prohibited and will result in immediate account termination.
12.Prohibited Conduct
Both clients and providers agree not to use the Platform to:
- Engage in any illegal activity or facilitate illegal acts
- Harass, threaten, stalk, intimidate, or discriminate against any user
- Post false, misleading, defamatory, or deceptive content or information
- Solicit, accept, request, or facilitate off-platform payments for services booked through Anixiv. This includes but is not limited to cash, Venmo, Zelle, PayPal, CashApp, direct bank transfers, cryptocurrency, or any other payment method not processed through the Anixiv platform. Both Clients and Providers who engage in off-platform payment transactions forfeit Anixiv's dispute resolution protections, chargeback coverage, and payment guarantees.
- Share another user's personal information (including real phone numbers or addresses) without their consent
- Upload content that infringes another person's intellectual property rights
- Use automated tools, bots, or scrapers to access or extract Platform data without authorization
- Create fake accounts, manipulate the bidding system, or engage in review fraud
- Interfere with or disrupt the Platform's infrastructure, servers, or networks
- Attempt to gain unauthorized access to other users' accounts or Platform systems
- Engage in any activity that could expose Anixiv or its users to legal liability
13.Intellectual Property
- Anixiv owns all rights, title, and interest in and to the Platform, including its design, code, branding, and all non-user-generated content.
- Users retain ownership of their own content (photos, reviews, portfolio images, messages) but grant Anixiv a non-exclusive, royalty-free, worldwide, sublicensable license to use, display, reproduce, and distribute that content on the Platform and in marketing materials.
- You may request removal of your content by deleting your account or contacting support@anixiv.com. Note that removal of reviews from the Platform does not guarantee removal from cached copies, search engines, or backups.
- You may not use Anixiv's name, logo, or branding without express written permission.
14.Communication and Privacy
- Masked communication. During active bookings, Anixiv provides a masked phone/SMS proxy (via Twilio) between clients and providers. Neither party's real phone number is shared with the other.
- Channel expiration. Proxy communication channels expire 72 hours after appointment completion. After that, direct communication through the Platform (in-app messaging) remains available.
- Metadata logging. Anixiv may log communication metadata (timestamps, direction, call duration) for safety, abuse prevention, and dispute resolution. We do not record or store the audio content of calls. In-app message content is stored to facilitate dispute resolution.
- Notification consent. Users consent to receiving service-related communications via push notification, email, and SMS. Marketing communications require separate opt-in. Notification preferences may be adjusted in account settings.
- Your personal information is handled according to our Privacy Policy, incorporated into these Terms by reference.
15.Dispute Resolution
We want to resolve issues quickly and fairly. Here is the process:
- Step 1. Direct resolution. Users should first attempt to resolve disputes directly through in-app messaging.
- Step 2. Platform mediation. If direct resolution fails, either party may contact Anixiv support. Anixiv will review the dispute and may issue refunds, credits, or account actions at its discretion. Anixiv's mediation decisions are final and binding within the Platform.
- Step 3. Binding arbitration. Legal disputes that cannot be resolved through Platform mediation must be submitted to binding arbitration. Court litigation is not available, except for small claims court.
Arbitration terms:
- Arbitration will be conducted under the rules of the American Arbitration Association (AAA).
- Governing law: State of Arizona.
- Venue: Maricopa County, Arizona.
- Class action waiver: you agree to resolve disputes individually and waive the right to participate in any class action or class-wide arbitration.
- Small claims exception: either party may bring eligible claims in small claims court without first going through arbitration.
16.Chargeback Policy
Chargebacks (credit card payment reversals) for completed services in which the service was provided as described constitute a violation of these Terms. Clients who file chargebacks for legitimately completed services may have their accounts suspended or terminated.
Anixiv offers tier-based chargeback protection for Providers:
- New Pro tier: Provider is responsible for chargeback losses. Anixiv assists with gathering and submitting dispute evidence to the card network.
- Established tier: Anixiv covers 50% of chargeback losses from the platform's chargeback reserve fund. Provider is responsible for the remaining 50%, which may be deducted from future payouts.
- Top Rated tier: Anixiv covers 100% of chargeback losses from the platform's chargeback reserve fund.
Chargeback protection is subject to the Provider maintaining good standing on the platform, including an on-platform payment rate of 95% or higher and a chargeback rate below 3%. Anixiv reserves the right to revoke chargeback protection for Providers with excessive chargebacks, confirmed Terms violations, or patterns suggesting fraudulent or substandard service delivery.
The chargeback reserve fund is maintained by Anixiv from a portion of platform fees. Anixiv makes no guarantee regarding the availability of funds in the chargeback reserve and reserves the right to modify the chargeback protection policy at any time with notice to Providers.
17.Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COM CONSULTING GROUP, LLC D/B/A ANIXIV, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
ANIXIV'S TOTAL CUMULATIVE LIABILITY TO ANY USER FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED THE TOTAL FEES PAID BY THAT USER TO ANIXIV IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Without limiting the above, Anixiv is specifically not liable for:
- The actions, omissions, or negligence of any provider or client
- Injuries, allergic reactions, skin irritation, property damage, or losses resulting from beauty services performed by a Provider
- Service quality, timeliness, or outcomes
- Provider licensing, insurance status, or legal compliance
- Third-party products, tools, or substances used by providers during services
- Platform downtime, data loss, or technical failures
In the event of injury, allergic reaction, skin irritation, property damage, or any other harm resulting from services performed by a Provider: the Provider is solely liable for any injuries, damages, or losses caused by their services, products, techniques, or negligence. Anixiv will refund the service fee charged through the platform as a goodwill gesture but assumes no further financial responsibility. Anixiv will document the incident and provide the Client with the Provider's business contact information to facilitate direct resolution. Anixiv may suspend or remove the Provider from the platform pending investigation.
18.Indemnification
You agree to indemnify, defend, and hold harmless COM Consulting Group, LLC d/b/a Anixiv, and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:
- Your use of or access to the Platform
- Your violation of these Terms
- Your violation of any law, regulation, or third-party right
- Any claim by a third party related to services you provided or received through the Platform
- Any content you submit, post, or transmit through the Platform
19.Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
ANIXIV DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.
Anixiv specifically does not endorse, warrant, or guarantee:
- The quality, safety, or suitability of any provider or their services
- That background check verification ensures provider safety or competence
- That any particular request will receive bids or be matched with a provider
- The accuracy of provider reviews, ratings, or portfolio representations
20.Modifications to Terms
- Anixiv may update these Terms at any time by posting revised Terms on the Platform.
- Material changes will be communicated via email or in-app notification at least 14 days before taking effect.
- The updated version will be identified by a new "Last updated" date.
- Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
- If you disagree with changes, you must stop using the Platform and may delete your account.
21.Termination
- You may delete your account at any time through your account settings, subject to a 30-day grace period before permanent deletion.
- Anixiv may suspend or terminate your account for violations of these Terms, fraudulent activity, or behavior harmful to other users or the Platform, with or without notice.
- Upon account termination: outstanding payments owed to providers will still be processed; pending bookings will be cancelled according to the Cancellation Policy; your personal data will be handled per our Privacy Policy and applicable law.
- Termination does not relieve you of any outstanding payment obligations or indemnification duties.
22.Miscellaneous
- Severability. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
- Entire agreement. These Terms, together with the Privacy Policy and the Provider Agreement (for providers), constitute the entire agreement between you and Anixiv regarding your use of the Platform.
- No waiver. Anixiv's failure to enforce any provision of these Terms does not constitute a waiver of the right to enforce it in the future.
- Assignment. Anixiv may assign these Terms and its rights without restriction. You may not assign your rights or obligations under these Terms without Anixiv's prior written consent.
- Force majeure. Anixiv is not liable for delays or failures in performance resulting from events beyond its reasonable control, including natural disasters, pandemic, government action, or infrastructure failures.
- Headings. Section headings are for convenience only and do not affect interpretation.
